01Agreement to these terms
These terms set out the conditions for using the DiazMedicare website. Opening the site, reading a page or submitting a form means these terms are accepted in full. Where they are not acceptable, the site should not be used.
02What this site provides
This site provides educational information and guidance about Medicare parts, plan types, prescription coverage and enrollment timing. It is a source of explanation and comparison, not a government agency and not an insurance carrier.
03Not a substitute for professional advice
Nothing on this site is medical, legal or tax advice, and nothing here creates an entitlement to any benefit. Coverage decisions carry personal consequences, so official plan documents and, where relevant, a qualified professional should be consulted before a choice is finalised.
04Eligibility to use the site
Use of the site is limited to residents of the United States who are of legal age. By submitting a form, the person submitting it confirms they meet that condition and that the details entered are truthful and complete.
05Accuracy of submitted information
Guidance can only be as accurate as the details it is based on. Prescriptions, provider names, coverage already in place and dates of birth all affect the outcome, and responsibility for the accuracy of those details rests with the person who submits them.
06Accounts and passwords
An account created on this site comes with a few conditions.
- Login details are personal and should not be shared with anyone else.
- Any activity that takes place under an account is treated as the responsibility of the account holder.
- Suspected unauthorised access should be reported through the contact page without delay.
- An account may be suspended where these terms are broken or where use appears fraudulent.
07Acceptable use
The site is offered for personal, lawful use only.
- Do not submit false details or impersonate another person.
- Do not attempt to interfere with, probe or overload the systems that run the site.
- Do not copy, scrape or republish site content for commercial purposes without written permission.
- Do not use the site in any way that breaks an applicable law or regulation.
08Text message permissions
Where permission is given at sign up, service messages and promotional messages may be sent to the number provided. Neither permission is a condition of purchase or of receiving guidance. Replying STOP ends the messages and replying HELP returns support information. Standard message and data rates may apply, and frequency can vary.
09Plan information and availability
Plan details, networks, drug lists and costs are set by the companies that offer them and can be revised without notice. Information shown or discussed on this site is offered in good faith but may change, and the plan documents issued by the carrier always take precedence.
10Intellectual property
The text, layout, graphics and arrangement of this site belong to DiazMedicare and are protected by applicable law. Reproduction, distribution or adaptation of that material without written permission is not allowed.
11Third party links
Links to carrier pages or official resources are offered for convenience. Those destinations are controlled by other organisations, and no responsibility is taken for their content, accuracy or practices.
12Limitation of liability
The site and its content are offered as they stand, without warranties of any kind. To the fullest extent allowed by law, no liability is accepted for indirect or consequential loss arising from use of the site or from reliance on the information it contains.
13Indemnity
Anyone who uses this site agrees to hold DiazMedicare harmless from claims, losses and expenses that arise out of a breach of these terms or a misuse of the site.
14Dispute resolution and arbitration
Disputes connected to this site or these terms are to be resolved through binding individual arbitration rather than in court, and class proceedings are waived, except where applicable law does not allow it. These terms are governed by the laws of the State of Colorado.
